User Agreement

1 Who May Use FaceSwap

You must be at least 13 years old to use FaceSwap. By using the app you confirm that you meet this requirement.

We strongly advise against use by children under 13. This age group typically lacks the legal understanding and judgment needed to use AI face-swap technology responsibly. Parents and guardians bear responsibility for supervising minors who access the app.

If you are between 13 and 18 (or the legal age of majority in your country), you confirm that a parent or guardian has consented to your use of this app.

2 Your Account

Accounts are automatically provisioned the first time you sign in with Google. There is no manual registration. You are responsible for safeguarding your Google credentials and for everything that happens under your account.

Any account with no recorded activity for 90 consecutive days will be permanently closed and all associated data erased. This process runs automatically and cannot be undone.

3 What You Are Allowed to Do

Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use FaceSwap for lawful, non-commercial purposes.

Permitted activities include:

• Processing photos or videos of yourself, or of other people who have given you their explicit, informed consent
• Creating entertainment content solely for personal use
• Sharing results on your own social media accounts in accordance with each platform's policies

4 Forbidden Activities

You must not use FaceSwap to:

• Create, share, or possess non-consensual intimate imagery ("deepfake pornography") or any sexually explicit content featuring identifiable individuals without their verified written consent
• Produce material designed to harass, defame, coerce, blackmail, or harm any person
• Impersonate another individual for deceptive ends, including identity theft, financial fraud, or political manipulation
• Generate hate speech, content inciting violence, or material that discriminates on grounds of race, ethnicity, religion, gender, sexual orientation, disability, or nationality
• Fabricate or disseminate disinformation, propaganda, or deliberately misleading content
• Process imagery of minors in any sexualized context
• Breach any applicable local, national, or international law or regulation
• Attempt to reverse-engineer, decompile, or misappropriate the app's AI systems or infrastructure
• Deploy bots, scripts, or other automated tools to abuse the service

5 Your Content & Consent Obligations

By submitting content to FaceSwap you represent and confirm that:

• You own the content or hold all necessary rights and consents from any identifiable individuals appearing in it
• The content does not infringe any third party's intellectual property, privacy, or other legal rights
• You have the authority to grant us a temporary, limited licence to process the content solely to deliver the face-swap service

This licence ends automatically once your uploaded content is deleted (within 9 hours of upload).

6 Risks of AI-Generated Content

By using the app you acknowledge that:

• AI output may not be accurate, appropriate, or suitable in every context
• The convincing nature of deepfake technology can cause genuine harm if misused
• We accept no liability for consequences resulting from your misuse of generated content
• Output files are automatically purged within 30 hours; no backups are kept — you must save files you want to retain before that window closes
• Any unlawful act carried out using content produced by this app is your sole legal responsibility. We will cooperate fully with law enforcement as required.

7 Intellectual Property

The FaceSwap app, including its design, AI models, algorithms, and branding, is owned by or licensed to us. This Agreement transfers no ownership rights to you.

You retain ownership of the original content you upload. AI-generated output is made available to you under a limited personal-use licence only; you do not acquire ownership of it.

8 Suspension & Termination

We may suspend or permanently close your account at our sole discretion, without prior notice, if we have reasonable grounds to believe you have violated this Agreement, applicable law, or the rights of a third party.

On termination, your access to the app will end and all associated data will be erased. Sections 6, 9, 10, and 11 of this Agreement continue to apply after termination.

9 No Warranties

FACESWAP IS OFFERED "AS IS" AND "AS AVAILABLE" WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the app will be free of errors, continuously available, or secure, nor that AI output will meet your expectations. We are not responsible for the accuracy or quality of AI-generated results.

10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM:

• Your use of or inability to access the app
• Unauthorised access to or modification of your data
• Any content generated through the app, including content you create and share
• Data loss attributable to the automatic deletion policies described herein
• Acts or omissions of any third party

Our total aggregate liability for any claim arising from your use of the app is capped at the amount you paid us (if any) in the twelve months prior to the claim, or USD $10, whichever is greater.

11 Your Indemnity Obligations

You agree to indemnify, defend, and hold harmless FaceSwap and its officers, directors, employees, and agents against any claims, damages, losses, costs, and legal fees arising from:

• Your use of the app in breach of this Agreement
• Your violation of any law or third-party right
• Any content you upload, process, or distribute using the app

12 Governing Law & Disputes

This Agreement is governed by applicable law. Disputes arising under this Agreement or from your use of the app should first be pursued through good-faith negotiation. If negotiations fail, disputes will be resolved by binding arbitration or a court of competent jurisdiction, as applicable.

Nothing in this clause limits either party's right to seek urgent injunctive or equitable relief to prevent irreparable harm.

13 Agreement Updates

We may revise this Agreement at any time. Significant changes will be communicated via an in-app notice or through an updated "Last updated" date at the top. Continuing to use the app after an updated Agreement takes effect constitutes your acceptance.

14 Complete Agreement

This Agreement, read together with the Privacy Notice, constitutes the entire understanding between you and FaceSwap concerning your use of the app, and supersedes all prior arrangements or understandings on the same subject.

If any clause of this Agreement is held unenforceable by a competent authority, the remaining clauses remain in full force.
